Abstract

From the growing demand of expert judgments in the practice of psychology associated with both a greater number of scientific papers relating to the credibility of the testimony as to a growing "psychologizing" of social life in general, this work aims to be a reflection about the idea of subject, his mental functioning and its relationship with the truth that is manifested in the trial proceedings. These ideas are particularly relevant in cases where the only evidence is the testimony of the victim and magnify their influence on the principle of immediacy. It emphasizes the distance between the developments of psychology related to the automatic nature, unconscious, nonlogical mental processes and characterization of the legal subject.
